Several top Democrats who called for the 25th Amendment to be used to remove former President Donald Trump from office during his term have remained silent on whether it should be invoked to remove President Biden, as some Republicans have suggested.

Fox News Digital reached out to Democratic Representatives Nancy Pelosi, Pramila Jayapal, Jamie Raskin, and Maxine Waters, as well as Senator Chuck Schumer, who declined to comment on whether the 25th Amendment should apply in President Biden’s case, while they suggested it should in the case of former President Trump.

Section 4 of the 25th Amendment gives the vice president and a majority of the executive Cabinet the power to decide whether the president is unfit to continue in office.

At various points during Trump’s presidency, Democrats called for the 25th Amendment to be invoked against the president, citing a variety of reasons, ranging from the coronavirus to Trump’s eligibility to the Jan. 6, 2021 riot at Capitol Hill.

“It’s been a long time now,” Waters told MSNBC In October 2020, he was asked if it was time to invoke the 25th Amendment based on Trump’s “erratic and bizarre behavior” and “personally spreading the virus.”

“Congress has a constitutional duty to establish a process by which to determine presidential incapacity, and a president of any party. This bill honors that duty by creating a permanent commission of top former executive officials and medical experts, selected in a bipartisan, bicameral manner. A president’s fitness for office must be determined based on science and facts. This law applies to future presidents, but we are reminded of the need for action because of the current president’s health.”

The bill was a reintroduction of the same bill introduced by Raskin in 2017.

“Since January, President Trump has pushed our country into chaos at every turn,” Raskin said in a 2017 article. Press release,

“For the safety of our people and the security of the republic, we need to form the ‘institution’ outlined in the 25th Amendment. The president can fire his entire Cabinet because they are asking the same questions that millions of Americans are asking at their dinner tables, but he cannot fire Congress or the expert body we established under the Constitution. In this time of unprecedented presidential chaos, the Oversight Commission on Presidential Capacity is necessary, urgently needed, and indispensable.”

Following the Jan. 6 riot, Pelosi, Raskin, Jayapal and every other House Democrat voted for a resolution calling on Vice President Pence to “declare President Donald J. Trump incapacitated to perform the duties of his office and to immediately assume his powers as Acting President.”

“We are demanding that Mike Pence and the Cabinet finally put America first and fulfill their Constitutional duty to invoke the 25th Amendment, ending Trump’s reign of terror and his total control over the military,” Jayapal said. “Assuming the vice president will continue to unleash this chaotic, dangerous president on the people of this country, the House of Representatives must immediately join me in my call to once again impeach Donald Trump.”
